Terms of Service

1. Purpose of Terms

These Terms of Service define the rights, obligations, and responsibilities between Press and Pull (hereinafter "Company") and users regarding the use of the Tog AI service (hereinafter "Service").

2. Definitions

• Service: The Tog AI mobile application and related services provided by the Company
• User: A person who uses the Service in accordance with these Terms
• Member: A user who has registered and created an account for the Service
• Workout Log: Structured data generated by AI from user's workout records
• Party: A group feature where members share workout records and communicate
• Credits: Units provided for using AI features in the Free plan

3. Effect and Modification of Terms

• These Terms become effective when posted on the Service screen or notified to users through other means.
• The Company may modify these Terms when necessary, within the scope of applicable laws.
• Changes to the Terms will be announced at least 7 days in advance, specifying the effective date and reasons for the change.
• If you do not agree to the modified Terms, you may discontinue use of the Service and withdraw your membership.

4. Service Content

The Company provides the following services:

• AI Workout Log Generation: AI analyzes chat-style memos and converts them into structured workout records
• AI Chatbot: Provides AI-based responses to workout-related questions
• Workout Statistics: Provides workout record analysis, Tog Level, PR records, and body part statistics
• Party Feature: Share workout records and social features with other members
• Other Additional Services: Stopwatch, notifications, etc.

5. Formation of Use Agreement

The use agreement is established when the user agrees to these Terms and completes the registration process according to the Company's procedures.

The Company may reject registration or terminate the use agreement afterwards in the following cases:

• Using another person's information
• Providing false information
• Being under 14 years of age
• Having previously lost eligibility due to Terms violations

6. Member Account

• Members can create an account through email or social login (Apple, Google).
• Members are responsible for safely managing their account information.
• Members must immediately notify the Company if they become aware of unauthorized use of their account.
• Members are responsible for damages caused by negligent account management.

7. Paid Services and Payment

7.1 Subscription Plans

7.2 Payment and Renewal

• Paid services are billed through the App Store or Google Play.
• Subscriptions are automatically renewed unless cancelled.
• Auto-renewal is processed 24 hours before the end of the current subscription period.

7.3 Subscription Cancellation

• Subscription cancellation can be done through subscription management in the App Store or Google Play.
• After cancellation, you can continue to use Pro features until the end of the current billing period.
• No refunds will be issued for amounts already paid upon cancellation, regardless of the remaining subscription period.

7.4 Refunds

• Refunds are subject to Apple and Google's refund policies.
• The Company does not have direct authority to process refunds; refund requests must be made through each store.

8. Credit System (Free Plan)

• Free plan members receive 100 credits per month.
• AI log generation consumes 8 credits, and AI chatbot usage consumes 1 credit.
• Credits are automatically reset monthly based on the registration date.
• Unused credits do not carry over.
• Credits cannot be transferred, sold, or converted to cash.

9. User Obligations

Users must not engage in the following activities:

• Using another person's information or registering false information
• Infringing on the intellectual property rights of the Company or third parties
• Defaming or interfering with the business of the Company or third parties
• Posting obscene, violent, or hateful content
• Commercial activities using the Service (without prior approval from the Company)
• Activities that interfere with the normal operation of the Service
• Accessing the Service or collecting data using automated means
• Distributing malicious code or exploiting system vulnerabilities
• Stalking, harassing, or threatening other members
• Other activities that violate applicable laws or these Terms

10. Party Usage Rules

10.1 Party Operation

• Parties are communities where members share workout records and support each other.
• Only Pro members can create parties.
• Party administrators have the authority to invite members, remove members, and delete the party.

10.2 Prohibited Activities in Parties

• Posting advertisements, promotions, or spam unrelated to workouts
• Defamatory, insulting, or discriminatory remarks toward other members
• Unauthorized collection or sharing of personal information
• Sharing illegal or harmful content

10.3 Sanctions

The Company may take measures such as warnings, forced removal from parties, or service restrictions against members who violate party rules.

11. Content Rights and Responsibilities

11.1 User Content

• Copyright of content posted by users on the Service (workout records, comments, etc.) belongs to the respective users.
• Users grant the Company a license to use the content within the scope necessary for Service operation.
• Users are legally responsible for the content they post.

11.2 Company Content

• Intellectual property rights for software, designs, trademarks, etc. included in the Service belong to the Company.
• Users may not reproduce, distribute, or modify these without prior written consent from the Company.

12. AI Service Usage

12.1 Characteristics of AI Service

• Workout logs and chatbot responses generated by AI are for reference only and accuracy is not guaranteed.
• AI responses do not replace professional medical, health, or training advice.
• There is a risk of injury during exercise, so please consult with a professional before following AI advice.

12.2 AI Data Processing

• Data entered for AI feature usage is transmitted to third-party AI services (OpenAI, Google).
• This data is not used for AI model training.

13. Service Changes and Suspension

• The Company may change the content, features, and pricing of the Service.
• Significant changes will be announced in advance.

The Company may temporarily suspend the Service for the following reasons:

• System inspection, maintenance, or replacement
• Natural disasters or emergencies
• Other force majeure circumstances

The Company may terminate the entire Service for business reasons, with at least 30 days' prior notice.

14. Contract Termination and Usage Restrictions

14.1 Member Withdrawal

• Members can request withdrawal at any time through the app settings.
• Upon withdrawal, all data (workout records, party activities, etc.) will be permanently deleted and cannot be recovered.
• If you have an active paid subscription, you must cancel the subscription before withdrawing.

14.2 Usage Restrictions

The Company may restrict Service usage or suspend accounts in the following cases:

• Violation of these Terms
• Interference with Service operation
• Causing harm to other members
• Violation of applicable laws

15. Disclaimer

• The Company is not responsible for service interruptions due to natural disasters, war, or other force majeure.
• The Company is not responsible for service usage issues caused by user negligence.
• The Company is not responsible for the reliability or accuracy of information posted by users.
• The Company does not intervene in or take responsibility for disputes between users or between users and third parties.
• The Company is not liable for free services except in cases of intentional misconduct or gross negligence.

16. Damages

• If damage occurs to users due to the Company's intentional misconduct or gross negligence, the Company will compensate for damages in accordance with applicable laws.
• If users cause damage to the Company by violating these Terms, such users must compensate for the damages.

17. Dispute Resolution

• In case of disputes related to Service usage, the Company and users shall negotiate in good faith for amicable resolution.
• If negotiation fails, disputes shall be resolved in the competent court under the laws of the Republic of Korea.

18. Governing Law

These Terms shall be interpreted and applied in accordance with the laws of the Republic of Korea.
